Holiday pay on death of a worker

19th June 2019

The European Court of Justice (ECJ) released its decision in June 2014 in the case of Gülay Bollacke v K + K Klaas & Kock B.V. & Co. KG. This case involved a worker accruing paid annual leave which they were unable to take due to sickness absence who then subsequently passed away. The ECJ held that the death of a worker does not extinguish his/her right to paid annual leave. This case law review provides an overview of the case, the decision made by the ECJ and practical considerations for colleges. This and other case law reviews are available to download from our case law review section of our website.
