Holiday pay on death of a worker
19th June 2019
The European Court of Justice (ECJ) released its decision in June 2014 in the case of Gülay Bollacke v K + K Klaas & Kock B.V. & Co. KG. This case involved a worker accruing paid annual leave which they were unable to take due to sickness absence who then subsequently passed away. The ECJ held that the death of a worker does not extinguish his/her right to paid annual leave. This case law review provides an overview of the case, the decision made by the ECJ and practical considerations for colleges.
