Correction to the Enrolment of 14- to 16-year-olds in full-time further education

11 March 2016

DfE have identified an error in the guidance on direct enrolment of 14-16 year olds, which incorrectly makes reference to the previous SEN Code of Practice. The recently published guidance Enrolment of 14- to 16-year-olds in full-time further education paragraph 21 states: Admission appeals 21. "While the school admission code and SEN Code of Practice apply to maintained schools, they do not apply to colleges’ post-16 provision. Colleges should use these documents as a model for the expected practice for 14 to 16 provision with colleges. College admission arrangements should be published in a manner accessible to students and parents." Clearly the wording in the guidance (that the Code of Practice does not apply to colleges) is misleading and wrong. EFA will be updating their guidance urgently, and hope to get a revised version out as soon as possible. The 0-25 SEND Code of Practice does applies to schools and colleges, and colleges must have regard to it.
