We are currently drafting guidance on this issue, which will include the recent Employment Appeal Tribunal decision. Our guidance will be published and available on our website once finalised. We expect that colleges will need to assess the potential impact of the EAT decision on a case by case basis as it will depend on contractual arrangements locally.
